Complaints & Appeals

All DWR decisions may be appealed under N.D.C.C. § 61-03-22 by submitting a request to the appropriate Division. To access contact information for each division, including phone numbers and email addresses, visit the DWR division contact directory.


Unauthorized Construction Of A Drain, Dam, Dike, Or Other Device

Complaints of unauthorized construction of a drain, dam, dike, or other device may be filed with the Water Resource District (WRD) of jurisdiction.

A WRD will determine if a landowner or tenant constructed a drain, dam, dike, or other device without securing the proper permit, contrary to N.D.C.C., or in conflict with the conditions of a permit.

A WRD decision on this matter may be appealed to the DWR within 30 days of receipt of the WRD’s decision on the complaint.

If the WRD does not act on the complaint within 120 days, the original complaint may be filed with the DWR within 150 days of the original submittal date.
